Terms of Service

1. Introduction and Acceptance of Terms

Continued use of the Services after updates or revisions constitutes acceptance of the modified Terms.

3. Intellectual Property & Trademark

All indicators, tools, and services provided by AlgoXcalibur LLC are the exclusive intellectual property of the company. Unauthorized reproduction, distribution, or use of any part of the Services is strictly prohibited and may result in legal action.

The term “AlgoXcalibur” is trademarked by AlgoXcalibur LLC. This includes any names, logos or branding that incorporate the AlgoXcalibur trademark itself. Unauthorized use of the trademark is a violation of trademark law and will be subject to legal enforcement.

Accuracy of Information: You are responsible for ensuring that the information you provide at the time of payment (Email, TradingView username, etc.) is accurate and kept up to date.
Security and Fair Use: You agree not to share your access or engage in any activity that disrupts or circumvents the intended use of our services. Abuse or unauthorized distribution will result in immediate termination of access and may lead to legal action.
Not Financial Advice: Our services are provided for informational and educational purposes only. You should consult a licensed financial advisor to assess your risk tolerance and overall financial situation before making any trading or financial decisions.

By using our Services, you accept full responsibility and accountability for your actions, decisions, and their outcomes.

5. Prohibited Use

Users agree not to use the Services for any of the following, including but not limited to:

Illegal Activities: Engaging in any activity that violates local, state, national, or international laws or regulations, including fraud, theft, or other criminal behavior.

Sharing of Subscription Benefits: Sharing account access, proprietary tools, or exclusive content with non-subscribers.

This list is not exhaustive, and any acts we deem to be misuse of the Services, whether explicitly mentioned or not, may result in suspension or termination of access and potential legal action.

6. Termination

We reserve the right to terminate or suspend your access to our Services without warning, for any reason we deem necessary. This includes, but is not limited to, situations where we determine that you have violated these Terms or engaged in any unauthorized, unlawful, or harmful activity.

All terminations initiated by us will immediately result in a lifetime ban without eligibility to regain access under any circumstance.

Upon termination:

Your access to our indicators, tools, and services will be immediately revoked.
Any remaining subscription time will not be refunded.

AlgoXcalibur LLC reserves the right to pursue any necessary legal action in response to violations of these Terms, fraudulent activity, or any other form of misconduct. Such actions may include, but are not limited to, seeking damages, filing legal claims, or reporting violations to appropriate authorities.

7. Indemnification

You agree to indemnify, defend, and hold harmless AlgoXcalibur LLC, including its subsidiaries, affiliates, officers, directors, employees, agents, licensors, consultants, suppliers, and any third-party service providers, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:

Your use or misuse of the Services – Including reliance on any indicators, tools, or data provided by AlgoXcalibur LLC, and any resulting trading decisions or outcomes.
Violations or failures to comply – Including any violations of these Terms, applicable laws, regulations, or third-party rights, as well as failure by you or anyone using your account to follow rules or meet responsibilities outlined in this document.
Unauthorized or harmful activities – Conducted through your account or in connection with your use of the Services.

You further agree to reimburse all legal costs, court fees, and damages resulting from claims brought against AlgoXcalibur LLC due to your actions, including any harm to the company’s reputation.

This obligation to indemnify AlgoXcalibur LLC shall survive termination of your account or cessation of Services.

To the maximum extent permitted by law, AlgoXcalibur LLC, including its representatives, affiliates, agents, licensors, and partners, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the Services.

This limitation of liability includes, but is not limited to:

Trading losses or financial outcomes resulting from reliance on or use of our indicators, tools, or services.
Errors, inaccuracies, omissions, or misinterpretations in the indicators, tools, or services.
Technical issues resulting in the inability to use the Services, such as delays, interruptions, or errors in their operation.
Third-Party Services – Our Services integrate with platforms such as TradingView, which are managed by independent third parties. AlgoXcalibur LLC is not responsible for errors, disruptions, or data inaccuracies caused by such third-party platforms. Users should consult their Terms of Service separately.

Users accept full responsibility for their trading decisions, actions, and outcomes when using AlgoXcalibur LLC’s indicators, tools, services, or third-party content. All use of the Services is strictly at your own risk.

The Disclaimer is an integral part of the Terms of Service agreement and should be reviewed carefully before using our Services.

Not Financial Advice

AlgoXcalibur does not have access to the personal trading accounts or brokerage statements of its users. Consequently, we cannot confirm that our users perform better or worse than the broader trading community based on our services.

Tax Liability

AlgoXcalibur LLC does not offer tax advice. It is your responsibility to determine, calculate, and meet all tax obligations related to your trading activities.

AlgoXcalibur LLC’s indicators and tools are used on the TradingView platform, a registered trademark of TradingView, Inc. We are neither affiliated with nor endorsed by TradingView.

Company Policies

At AlgoXcalibur, we strive to provide a seamless and professional experience. Please familiarize yourself with our policies before purchasing a membership.

1. Refund Policy

All sales are final once access to services has been granted.

Refunds are not provided except under rare and specific circumstances, such as:

You experience a verified technical malfunction, outage, or functionality failure that prevents access to services.
The services are unusable for a prolonged period due to a confirmed platform failure.
There is a failure on our part to provide you with services in a timely manner.

If a refund is granted:

Access to all indicators, tools, and services will be immediately revoked.
Users may rejoin at any time by purchasing a new membership.
Refunds, if approved, are processed within 3–5 business days.

Important Notes:

Refunds are not available due to dissatisfaction with personal trading results, user error, or change of preference.
Refunds are not available for auto-renewal charges.
Refunds are not available if your account is terminated for violation of our Terms of Service.

Cancellation Policy

You may cancel your membership at any time by visiting your subscription portal (under “Manage Account”) on the homepage or by contacting the support team via the contact form available at https://www.algoxcalibur.com/contact.

Cancellations will take effect immediately, but access to services will remain active until the end of your current billing cycle, and no further charges will be incurred.

Important Notes:

Cancellation must be completed prior to your renewal date to avoid renewal charges.
Access to indicators, tools, and services will remain active until the end of your current paid billing period after cancellation.
If you decide to cancel, you are always welcome to rejoin at any time by purchasing a new membership.

Free Trial Policy

We do not offer free trials.

Our services are designed for serious traders who understand the value of proprietary tools and insights. By purchasing a membership, you acknowledge that you are gaining immediate access to digital services and waive any right to a free trial period.

2. Charity Donations Policy

AlgoXcalibur LLC is committed to giving back by supporting charitable causes. Each month, 10% of profits from our services are donated to charities selected by AlgoXcalibur members through a community voting process at: https://www.algoxcalibur.com/charity-voting.

Voting Rules:

All votes must be submitted through the official voting form.
The submitted email address must match records in the member database to be counted.
Only one vote per member will be accepted. If multiple votes are submitted, only the most recent valid vote will count.
In the event of a tie, donation funds will be split evenly (50/50) between the tied charities.
AlgoXcalibur LLC reserves the right to make the final decision in the event of disputes, ineligible submissions, or unforeseen circumstances affecting the selection process.

The poll results will be announced at the end of each monthly cycle via email to members and will also be publicly available at: https://www.algoxcalibur.com/charity-voting.

While we strive to make consistent monthly contributions, AlgoXcalibur LLC reserves the right to pause donations if necessary due to business performance or operational needs. Any updates to the donation program will be disclosed for transparency.

3. Dispute Resolution and Legal Terms

Informal Resolution

If you have any disputes or concerns regarding our Services, we encourage you to fill out the contact form available on our website https://www.algoxcalibur.com/contact to seek an informal resolution. We aim to address disputes promptly and professionally.

Mediation

If a dispute cannot be resolved informally, the parties agree to first attempt to resolve it through mediation with a neutral mediator, mutually agreed upon by both parties. The costs of mediation, including mediator fees and associated expenses, will be shared equally by both parties. Mediation will take place in North Carolina, and the process will be conducted in good faith to seek a fair resolution.

Binding Arbitration

If mediation is unsuccessful, disputes may be resolved through binding arbitration conducted in North Carolina and in the English language. The arbitrator’s decision will be final and binding, and judgment on the arbitration award may be entered in any court of competent jurisdiction.

Costs and Fees: Each party will bear its own costs and attorney fees related to arbitration unless the arbitrator determines that one party has violated these Terms or if applicable law requires otherwise. In such cases, the arbitrator may award reasonable fees and costs to the prevailing party."

Legal Costs and Liability

In the event of a lawsuit in court, you agree to pay all legal costs, court fees, and damages incurred by AlgoXcalibur LLC, as outlined in the Indemnification section. By using our Services, you acknowledge that they are to be used at your own risk, as further detailed in the Limitation of Liability and Disclaimer sections of this document.

No Class Action

You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, collective, or representative action.

Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

By using our Services, you agree that any disputes or claims arising out of or related to this Agreement will be resolved exclusively in the state or federal courts located in North Carolina.
